Terms of Service

By creating an account, completing a purchase, or tapping an ohmystamp NFC stamp at a participating shop, you agree to these Terms of Service. If you do not agree, please do not use the service.

ohmystamp is a tap-to-stamp loyalty platform. Merchants subscribe to a plan and receive a physical NFC stamp and a per-shop web page. Their customers tap the NFC stamp at the counter, register a name and phone number, and accumulate loyalty stamps that may be redeemed at that merchant according to the merchant's own reward rules. ohmystamp is operated in Canada.

• You must be at least 18 years old, or the age of majority in your jurisdiction.
• Merchants must operate a legitimate business and provide accurate information at sign-up.
• You agree to use the service only for lawful purposes.

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us promptly at support@ohmystamp.com if you suspect unauthorized access.

• Subscription fees are billed in advance through Stripe in Canadian dollars (CAD) at the rate displayed on the pricing page at the time of purchase.
• Subscriptions renew automatically each billing cycle until cancelled. You may cancel at any time; the cancellation takes effect at the end of the current billing period.
• Payments are non-refundable except where required by law. We do not offer pro-rated refunds for partial billing periods.
• If a renewal payment fails, your service may be suspended until payment is restored.
• Promotional pricing or discount codes are subject to their stated terms and may be withdrawn or modified for future periods.

After successful payment, we ship the NFC stamp to the address provided. Shipping is included in the subscription fee for standard delivery within Canada. The stamp remains the property of the merchant once received, but the underlying credentials encoded on it remain bound to the merchant's ohmystamp account.

You agree not to:

• Use the service for fraudulent or unlawful loyalty schemes
• Misrepresent another person or business
• Attempt to bypass, reverse-engineer, or attack the service or its security controls
• Use automated means to issue stamps without legitimate customer interaction
• Resell, sublicense, or repackage the service without our written consent
• Use the service to harass, abuse, or harm others

Merchants are responsible for honoring their stated reward rules, complying with consumer protection laws applicable to their business, and providing accurate information to their loyalty customers.

ohmystamp and related marks are the property of their respective owners. The service, including its software, design, and content created by us, is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the service per these Terms.

We strive to keep the service available, but we do not guarantee uninterrupted availability. The service is provided on an "as is" and "as available" basis. Planned maintenance and occasional outages may occur.

You may stop using the service at any time. Merchants may cancel their subscription from their account or by contacting support. We may suspend or terminate accounts that violate these Terms, with notice where practicable. Upon termination, your right to use the service ends; data retention follows our Privacy Policy.

To the maximum extent permitted by law, ohmystamp is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data.

Merchants agree to indemnify and hold harmless ohmystamp from claims arising out of their use of the service in violation of these Terms, their failure to honor stated reward rules, or their handling of customer information outside what is necessary for the loyalty program.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict-of-law principles. Any dispute will be resolved by the courts located in Toronto, Ontario, unless mandatory consumer protection laws of your jurisdiction provide otherwise.

We may update these Terms from time to time. If changes are material, we will notify active users by email or in-app notice before the changes take effect. Continued use of the service after changes take effect constitutes acceptance.
